New CMS Rule Requires Select Healthcare Facilities to Have Vaccinated Employees – Does it Apply to You?

On November 5, 2021, the Biden-Harris Administration passed a new rule which requires certain Medicare and Medicaid-certified facilities to implement mandatory vaccination policies for their employees. Qualified vaccines are limited to Pfizer, Moderna, and Johnson & Johnson. Phase 1 of the rule will require employees to receive their first dose of a vaccine by December 6, 2021 (or last dose if J&J), and Phase 2 will require employees to receive their second dose by January 4, 2022. However, employees may still seek medical or religious exemptions, excluding them from the vaccination requirement.
